DecoBD Privacy Policy

  1. Preamble

 DecoBD (the “Platform”) is keen to protect the privacy of its members as best as possible and does everything possible in this context. DecoBD undertakes in particular to ensure a level of protection of personal data in accordance with the General Data Protection Regulations (“GDPR”), including all French legislation and regulations implementing, supplementing or replacing the RGPD where applicable. . DecoBD collects and processes personal data relating to Members.

Members designate users who have registered on the Platform and whose registration has been validated by DecoBD. This confidentiality policy (the “Confidentiality Policy”) describes the methods of collecting and processing personal data relating to Members. The processing of personal data is implemented by the company EQUIPROD INNOVATION, a simplified joint stock company, registered with the RCS of Lille Métropole, under number 798 362 067, whose head office is located at 50 Rue du petit village, 59200 Tourcoing (cited -after, “DecoBD”).

DecoBD also collects data concerning Members, and more generally users of the Platform, through cookies, as more fully described in DecoBD’s cookie policy.

  1. Personal data collected by DecoBD

DecoBD collects personal data directly from each Member, at the time of registration on the Platform, and in particular:

  • information relating to their registration: their login, pseudonym and email address (the password, if collected, is then non-reversibly encrypted and not collected as such);
  • information relating to the profile of the self-employed Member or individual business: their company name or company name, their first and last name, their registration number if applicable, their VAT number, the address of their head office, their contact details (telephone, email), their Instagram username, a copy of the identity card or passport of the legal representative;
  • information relating to contacts within Members who are legal entities: the first and last name of a natural person contact, the first and last name of legal representatives or any person duly authorized to engage the Member, and their respective contact details (telephone , E-mail) ;
  • information relating to product orders placed through the Platform: the product(s) purchased, the transaction number, the delivery address, etc. ;
  • bank details: RIB and SEPA mandate.

Other data is collected directly from each Member during the duration of use of the Platform, or when the Member communicates through the Platform, such as in particular:

  • the information that the Member provides when leaving a review on the Platform;
  • exchanges between Members or with customer service if applicable (content of exchanges, nature of the complaint, etc.);
  • data relating to consultation of emails that DecoBD sends to Members (administrative or commercial prospecting emails);

The data collected for the execution of the general conditions of use, compliance with our legal or regulatory obligations, or those which condition the conclusion of the general conditions of use must be provided. Otherwise, DecoBD will not be able to make the functionalities of the Platform available to the user.

  1. Purposes and legal bases for the collection of Members’ personal data and duration of data retention by DecoBD

DecoBD collects the personal data of Members listed in Article 2 in order to provide them with the best possible service. The table below allows Members to have an overview of the methods of processing their personal data when using the Platform.

  1. Recipients of personal data

The personal data collected and processed by DecoBD may be communicated to the following recipients or categories of recipients:

  • To natural persons authorized by DecoBD to process the personal data of Members, after having signed a confidentiality agreement, and in particular DecoBD employees;
  • To other Members: the personal data of the Member who places an order via the Platform with another Member is transmitted to this Member. Each of these Members acts as a separate data controller;
  • To carriers who will act under the responsibility of the Member who ships the order or DecoBD if applicable;
  • To service providers to whom DecoBD subcontracts all or part of the processing carried out by DecoBD relating to the personal data of Members, in particular:
  • the payment service provider for secure online payment transactions;
  • the service provider providing interested distributors with various packaging in DecoBD colors;
  • the host of the Platform and data;
  • the Platform maintenance provider;
  • the mailing service provider for sending transactional emails relating to orders placed via the Platform;
  • emailing providers for sending newsletters and various marketing mailings. The subcontractors used by DecoBD provide sufficient guarantees required by the applicable regulations regarding the protection of personal data.

DecoBD’s subcontractors only have access to the data necessary for the performance of their services and are not authorized to process Members’ data for other uses.

  • To the financial partner of DecoBD who acts as a separate data controller;
  • To the payment provider, who acts as a separate data controller, in order to enable it to fulfill its legal and regulatory obligations;
  • To the partner offering distributors various packaging in the colors of DecoBD, which acts as a separate processing manager, for distributors who have placed an order;
  • To DecoBD’s external advisors: lawyers, accountants, auditors, etc., bound by an obligation of confidentiality;
  • To the authorities: Members’ personal data may be disclosed to the competent authorities in accordance with the law and/or a court decision;
  • To any third party in the event of merger-acquisition, total or partial transfer of assets, direct or indirect change of control, or any other form of restructuring implemented by DecoBD.
  1. Duration of retention of personal data

DecoBD only retains Members’ personal information for the period strictly necessary for the purposes set out in Article 3. Members’ data is subsequently archived with restricted access for an additional period in order to enable DecoBD to fulfill its obligations. its legal and/or regulatory obligations regarding archiving and retention of data. At the end of this additional period, Member data is permanently deleted from the DecoBD databases.

  1. Rights of Members

Members have a right of access, rectification, erasure and portability of their personal data, as well as a right of opposition, withdrawal of their consent and limitation of processing, under the conditions provided by the applicable regulations. Members may, at any time, object to the processing of their data for commercial prospecting purposes or in accordance with applicable regulations. If Members consider that their rights have not been respected, they may lodge a complaint with the National Commission for Information Technology and Liberties (CNIL) or with any other competent authority.

  1. Modification of the Privacy Policy

DecoBD reserves the right to modify and/or update this Privacy Policy at any time. The revised Privacy Policy will be posted online on the Platform indicating the last update date.
